This Privacy Policy ("Privacy Policy") describes the policies and practices of Tapingo Inc. ("we," "us," or "Tapingo") and the choices you have in connection with collection, use and disclosure of your personal information that you provide to us or that may be generated by your use of our Web site, software applications (such as apps downloaded from the Apple App Store or Google Play) (the “Software”) and online services (the "Service"). This Privacy Policy does not apply to personal information that you provide to us or that we collect from you offline. Please review carefully this Privacy Policy before making any use of the Service. Each use of the Service by you constitutes your consent to the collection, transfer, storage, disclosure and other uses of your personal information as described in this Privacy Policy.
The Privacy Philosophy of Tapingo and Security
Your privacy is important to Tapingo. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, due to the nature of Internet communications and evolving technologies, unauthorized entry or use, hardware or software failure, and other factors, the security of user information may be compromised at any time. Collection of Personal Information
When you create an account with us in order to use the Service, you will be asked to provide certain personally identifiable information about yourself such as your name, user name, email address, telephone number, address of your residence, credit card and/or payment details and password and when you use the Service you may provide us with further details such as purchases for products and services made by using the Service. Your personal information will be stored in the Service database and will be used in accordance with this Privacy Policy and the requirement of the applicable law. If you register with us through Facebook, your Facebook profile, including your photo, list of friends, date of birth and other information provided through Facebook, may be disclosed to us, be shared with other users of the Service, and stored in our database. You are not required to provide us with your personal information. However, in certain cases, if you decide not to provide information about yourself (such as, your telephone number and email address), or enable certain features (such as, your location identification), you might not be able to complete the applicable registration process, or use certain features of the Service.
How We Use Your Personal Information
The personal information you provide to us may be used for a variety of purposes, such as to register with, log-in, and use, the Service, interact with vendors and service providers presented to you through the Service, fulfill and charge your payment method for orders and purchases made by you through the Service including without limitation, any delivery costs, and interact with other users. Your personal information may also allow us to communicate with you about the status of your orders and purchases or other administrative issues, improve the contents provided through the Service, customize the advertising and content you see, and communicate with you about promotions, special offers and new features. Our affiliates, Merchants vendors, service providers and partners (including third party payment processors) may disclose information you share with them to us, and we may use such information as provided for in this Privacy Policy.
When you use our Service through a mobile device such as a cellular phone, tablet computer or other type of cellular device or through your personal computer or any other device with Internet connectivity ("Device"), we may collect information about such use that does not necessarily identify you personally, although it may be unique to you or consist of, or contain information that you may consider personal. Such information may include, without limitation, the type of device you use, the type of browser and operating system you use, your Internet protocol addresses (including any host name or geographic information associated with these addresses), the Bluetooth MAC Address, WiFi MAC Address, IMEI number of your Device, carrier and basic usage statistics, information related to your computer or device system configuration, and interoperability of the Device and Service applications. In addition, when using location-enabled services, your Device will be sending to our servers location data from the Device, which may reveal your exact location and which may enable Tapingo to provide you with its unique location-enabled services. Should you wish this information not to be provided to Tapingo, please do not subscribe to such services and/or uninstall the Software from your Device.
Tapingo uses "cookie" technology, web beacons, and log file information for purposes such as: (a) collect website users' usage data to enable easy access to the Service and otherwise improve the Service; (b) provide custom, personalized content and information; (c) monitor the effectiveness of the Service; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track your entries and submissions to the Service. A "cookie" is a small data file that is transferred to your Device's hard disk. Most Internet browsers automatically accept cookies. Ads appearing on the Service may be delivered to you by our advertising partners, who may set cookies on your Device. Such cookies allow the ad server to recognize your Device each time they send you an online advertisement to compile information about you. This information allows ad networks to deliver targeted ads that such networks believe will be of most interest to you. You should change your browser settings if you do not wish to accept cookies from us on your Device. This Privacy Policy covers use of cookies used by Tapingo and does not cover the use of cookies by any third party advertisers.
Tapingo stores and processes your information on computers located in the United States that are protected by physical as well as technological security devices.
How We Share Your Personal Information
Tapingo is a platform that connects users with Merchants and service providers. In order to operate the platform, we need to share information about you and your orders with the other third parties who help enable the Service. This includes, without limitation, Merchants who sell and provide food and drink products and services, payment processing partners that we use to validate and charge your payment details and delivery persons who deliver your orders to you. To be clear, only our payment processing partners receive any credit card information.
To simplify ordering through the Service we will ask you to provide us with your credit card or stored-value card number, CVV number, its expiration date and any other details needed in order to facilitate transaction through the use of the Service. We will transmit this information safely over the Internet in a secure manner and store it in a secure server. This information will be used only to bill you for the products and services you order and purchase through the Service. We may share such information as well as information such as your name, telephone number and email address with our credit card payment processing partners in connection with fulfillment and payment of orders you submit through the Service. We may share information such as your name, telephone number and email address (but not payment details, such as credit card details) with our vendors in connection with fulfillment orders you submit through the Service. We may share information such as your name, telephone number and the delivery address you provide us (but not payment details, such as credit card details) with our delivery persons in connection with delivery of the orders you submit through the Service. We ask these entities and persons to use, store or retain such information only for purposes related to the transaction, however, since we have no control over these entities and persons, we cannot guarantee that such information will not be used for other purposes and we will have no liability if such event occurs.
We may also disclose your personal information to third parties (a) to comply with any applicable law, regulation, legal process (including any court order) including without limitation any court order, law enforcement investigation or governmental request, (b) to perform certain administrative functions consistent with our Privacy Policy on our behalf, including in connection with customer support, Web hosting services, fulfillment companies (such as, companies that fill product orders or coordinate mailings), and data analysis, (c) to protect the safety of our users, our employees and our property, and (d) and in connection with enforcement of this Privacy Policy, the Software End User License and the Service Terms of Use.
We may also share with some of our business partners (such as, Merchants, retailers, and data collection companies) general information related to your use of the Service without disclosing your identity in order to improve the Service and your user experience.
We may also share with Merchants, service providers and advertisers on both a non-personally identifying basis (including order and delivery details, but not including credit card information) and an aggregate basis.
How You Can Protect Your Privacy
Your personal account with the Service is password-protected for your privacy and security. At all times, you will need to protect your password appropriately and limit access to your Device to prevent unauthorized access to your account and personal information.
When you submit or make available your personally identifiable and other personal information through the Service, you are giving your consent to the collection, use and disclosure of such information pursuant to this Privacy Policy. If you do not wish that we collect any personally identifiable information from you, please do not provide us with any such information.
Reviewing and Updating Your Personal Information
You will be able at any time to review, modify or update information included in your user's profile by logging in to your user account on the Tapingo Web site and selecting "My Account".
Policy Toward Children
This Site is not directed to children under 18. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us at support@tapingo.com. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files.
International Transfers
Our Service may be provided using resources and servers located in various countries around the world. Therefore your personal data may be transferred across international borders outside the country where you use our Service, including countries that do not have laws providing specific protection for personal data or that have different legal rules on data protection. In such cases we take steps to ensure that there is a legal basis for such a transfer and that adequate protection for your personal data is provided as required by applicable law, for example, by using standard agreements approved by relevant authorities (where necessary) and by requiring the use of other appropriate technical and organizational information security measures.
Opt-Out Options and Unsubscribing
Tapingo may send you, from time to time, email communications, with news and updates about the Service or other products, as well as other marketing communications and promotional offers. If you do not wish to receive from us such marketing communications, you can opt-out, at any time, by sending us an email to emailunsubscribe@tapingo.com requesting removal of your email address from any such mailing lists. Please be sure to include your full name and email address and indicate what type of marketing communications you do not wish to receive any longer. If applicable, you may also opt-out receiving marketing communications from us by following instructions on our email communications explaining how to unsubscribe from the email mailing lists of Tapingo. We will take appropriate steps to fulfill your request, however, it may take a few days or longer to process your request during which you may still receive marketing communications from us. Tapingo reserves the right to send you notices about your account, even if you opt-out of all email notifications.
If you decide to terminate your account with us, you may do so by sending us an email to support@tapingo.com specifying your request and providing us with your name and email address, or by selecting the "Delete Account" link on your account settings page. If you terminate your account, your profile will be removed from the Service, however, deletion may not be immediate and Tapingo may continue keeping your personal information in its records for billing purposes, audits and other administrative purposes.
Third Party Links
The Service may contain links to third parties' web sites. While we attempt to provide links to sites that value your privacy, we cannot be responsible for the content or privacy policies of such sites. We encourage you to carefully review the privacy policies of such third parties' Web sites linked or provided through the Service prior to any use of such Web sites.
Tell-A-Friend
If you choose to refer a friend to the Service, we will ask you to provide your friend's email address and telephone number. This information will be used only to send a one-time message to your friend inviting him or her to register with the Service.
Business Transfers
In the conduct of our business, we may sell certain of our assets. Information collected from users of the Service, including personal information, could be transferred as part of such transaction. By submitting your personal information through the Service, you agree that your information may be transferred to third parties under such or similar circumstances.
Privacy Rights
Users who are California residents may request and obtain from us once a year, free of charge, certain information about the personally identifiable information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personally identifiable information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Tapingo may occasionally revise this Privacy Policy to reflect changes in its Services and other practices. Therefore, you should review Tapingo's Privacy Policy prior to each use of the Service, particularly each time before you submit your personal information through the Service, so you could be informed of any changes in our privacy practices. At all times, the most current version of our privacy policy will supersede any other versions of our privacy policy. You can determine when the Privacy Policy was last modified by checking the "Last updated" legend at the top of the Privacy Policy.
